>>93415464Having no artistic value ONLY does not qualify it for being banned or being a legal offense.
Philosophically regular porn gets away with it because if you were to call it vulgar and obscene and ban it because of that, it creates a slippery slope wherein you utterly fail to define what is vulgar and it drags everything down because you're banning everything any retard complains about being obscene.
So we set legal rules in place for what is or isn't obscene OBJECTIVELY, and that is condensed in the Miller Rule.
So, in the case of regular porn, you can easily prove that generally speaking, according to community standards, it is not obscene because look at how much "regular" porn is consumed in hotels at bookstores and sex stores. You can also show that according to state laws it's not obscene. You can't prove it has artistic value but that doesn't matter because you got 2/3 and you only needed to shoot down 1/3. And whoever is offended by porn has to fucking deal with the fact that they're too fucking stupid/lazy to learn what is legally and philosophically obscene.
In the case of loli (and other banned forms of pornography such as bestiality as well as things like video footage of actual people dying) it is very difficulty to argue down any of the three points of the Miller Test; and you only need to kill one; unfortunately it's almost impossible to do any one. When it comes down to loli, 100% of the time it's going to fail the community standards test, the state obscenity standards, AND show that it has no artistic value.
