That's not date rape, date rape-or any kind of rape-explicitly is about inability to consent properly during the act, not afterwards. You can't retroactively rape someone who consented 100 percent to the act. Him erasing her mind did not erase her consent during the actual act. Now, him erasing her mind IS assault as she didn't want any part of it and wouldn't have agreed to it, and he did not give her a choice in the matter, but that's a wholly different problem than a sexual act she was in favor of.
