Atom bombs? All belong to government.
Space faring vessels? All public again.
The government would AT LEAST TRY to control all superhumans, and try very hard, through strict regulations or straight up employing them.
It's too dangerous to let them flee to Russia and China and work against your nation's interests.
Owning a business is regulated by specific laws, dealing with security and weaponry even more so, there is no way a dangerous job like saving citizens and using force wouldn't be target of special laws, at least having mandatory insurance, at most being entirely under the government's eye.
You could be independent and free and offer your services to Google, Iran or Topsecurity ltd., or whoever offers more, but not before a big legal battle against the state, which will no doubt try to get a slice of your superpie.
Imagine you built a functioning Iron-man suit TOMORROW, you either become a private contractor and sooner or later the government shows at your doorstep asking politely or less to collaborate (if you're worth it), or you start doing literal police work in your neighborhood, and in that case there's no way you can choose not to share your evidence and clues with public prosecutors and investigators, just to make an example.
