>>124709507"Your website contains copyrighted work you have no right to redistribute" is enough, Sorry.
>>124709607Fair use is not an exemption to the DMCA, it's a list of exceptions the judges use once you're already sued and paying a lawyer to not go to jail. Fair use rarely applies because shitposts are far from original enough to follow traditional fair use requirements and describing how they're fair use is on you. Good luck describing for every shitpost how it's actually transformative and new. Parodies also are not inherently exempt from the DMCA if you can call most images even parodies.
Even with suitcase's limited coding abilities, it should be trivial for him to write a tool that allows him to casually browse through the most recent threads and click the images he wants gone. Automatically send out an email, that kind of stuff. If you protest his emails or ignore them, he can sue the shit out of you. And, like I said, he can just hire a company to take his IP and send out the notices for him.
In fact, there's nothing preventing him from sending a DMCA takedown for every image on your site, whether it's copyrighted by him or not. You have the right to protest the takedown notices, one at a time, but protest one too many and he's got you. This legal equivalent of DDoS is exactly why Youtube is plagued by DMCA bullshit and why every hosting company responds by taking down content and asking questions later.
The whole "legal" thing is pointless. Hell, if you make it as hard as possible for him to exercise his rights as granted by the DMCA, that could be a violation of the DMCA in and of itself. If you don't give him an easy way to do takedowns, you lose.
The DMCA fucking sucks and shouldn't exist. Fuck Disney. Also, nice captcha.
