Max is, after all, the result of some unorthodox science and neither the mom nor the mom could provide an Y for Max to have an XY make up. Now it's possible Bella had on of her X modified to make it an Y when her egg were turned into sperm. Or maybe Max actually has XX genes but developed a male body anyway, as it can sometimes happen.
