He stops villains and turns them over to Gotham's law to deal with. If they just slap them into Arkham, where they'll inevitably escape again, that's not on Batman. That's on Gotham as a society.
Batman goes so far as to bring them down and in. His mission is over once they're in Gotham's custody.
Batman isn't some Judge Dredd, meting out one-man justice and executing those he deems worthy of it.
He just stops the villain and brings them to the proper authorities. If those authorities fail to permanently stop that villain, he's ready to stop them again. It's not Batman's failure if Gotham City PD let's them escape, but he accepts that he has to plug the holes in Gotham's fractures facade.
That he doesn't follow the letter of the law is why he's the Dark Knight.
That he doesn't violate the spirit of the law is why he's a hero.
