Out of print means out of stock. As long as they have even one copy left to offer, they keep the rights. And it has to remain unavailable for a year
The point is that the books are not the issue here, The money DC makes from them is peanuts compared to the merchandising. To keep those merchandising rights, they'd be more than willing to take a small loss from the books, as has been pointed out.
Plus, while they keep the rights, they can make derivative works.
