That technically makes her a war criminal. But the XMen aren’t subject to the laws of the UN because they’re not officially Americans, not legally. So they’re vigilantes, which is just plain illegal not crimes against humanity illegal.
Also the shit storm (pun noted, left in) that woud erupt in arresting her and trying her for any battlefield use of her powers in offensive action. A black woman would get a lot of grassroots support, but it’s gonna be older white men deciding her fate innit?
The International Criminal Court has a reputation for only going after brown and black People already, partly because those countries are where interventions are staged and partly because white countries don’t turn over their war criminals (white countries make up the victors a lot). So everyone would see this as a HEROIC AFRICAN QUEEN being unjustly imprisoned for doing the right thing by a bunch of stodgy OLD WHITE MEN.
Or would it?
Storm could be seen as the tool of the oppressor since she works with Xavier to maintain a peaceful status quo that leaves mutants at the bottom, hoping for scraps. She could be seen as an American hotshot who flagrantly violates the laws like airspace sovereignty or even acts of war (weather manipulation in a country not your own?). Everyone could be happy she’s finally facing some sort of justice!
I love Storm I really do. But she’s literally breaking UN laws every time she fights with her power.
