Basically you cannot shoot in the head the first person you see that wants to harm another as the law will understand you weren't in such an extreme position that it is justifiable to take a life, as much other options were available.
Its a rule that heavily depends on circumstances and surely would be much tricky to apply in a comic setting, but it exists and makes sense.
To end with an example of a case of excessive force, we could say Luke Cage sees a hooded man following another. He decides to follow and suddenly the hooded man takes a knife and starts to run towards the other, knife raised. It would be very hard for Luke, who is invulnerable, to justify him tackling the hooded man and snapping his neck "because he was about to harm the other man", as other options existed.
