The answer is yes, they can be.
But it would require a change in copyright laws.
Make it so copyright only lasts 50 years after original publication.
Then Marvel loses a monopoly on some of its greatest characters.
Other companies make more compelling stories with them.

Disney owns the merchandising rights to Spider-Man. Also, Marvel made 6 billion BEFORE The Avengers release, when MCU wasn't anywhere near as big as it is now. So, current numbers should be somewhere between 7-9 billion per year. DC eternally BTFO
