The person selected is a member of the party who won the most seats in a Federal Election. Typically, this is the leader of that party, as they hold the confidence of the party to hold leadership. There's no official rules to this, only long standing convention. So it's impossible as it is to be elected Prime Minister. And I'm doubtful there's something in the criminal code about it.
