The Joker only escaped because Black Mask broke him out to deal with "The Red Hood." Since this was Jason's apparent intent, it's really his fault in the first place. In the universe of the movie, the Joker might well have spent the rest of his days in prison if it weren't for Jason, negating his whole argument that the Joker NEEDS to die for any reason other than his own revenge.
