I've never seen any context where the empty product was not defined as the multiplicative identity. Can you give me an example?
As for 0^0, when n is a whole number, x^n is usually defined as x times itself n times. So the "usual" definition of 0^0 would make it 1.
I do agree that this is only a matter of which definition is being used, but as far as I know, this is the "usual" definition.
