Even if we're talking about the observable universe: sure there's some good arguments that if intelligent life wasn't extremely rare it should leave some signs that would've been pretty obvious to us by now, but it's not very clear how large of an area we can judge be to be devoid of other civilizations. Even the observable Universe is mind-boggingly big, and we haven't looked very hard at all.
