Say I'm holding Jane at gunpoint, and I tell Joe that Jane will not get shot if he gets me a donut. I say the choice is his. (Even though I'm the one who made the choice to create this situation)

Is it a fallacy to imply it's his choice, and if so, does it have a name?

It literally is his choice, I don't see why it's fallacious. But the reasonable choice is obvious so it's a true but pointless/almost meaningless statement.

but it’s doesn’t hold up because you would have prove getting a donut would mean Jane does let get shot. you can’t prove this part so it’s a fallacy to imply it’s his choice
