The only, ONLY way the Basilisk makes sense is if you re-formulate it to have the implicit threat to torture people alive at the time of its creation who had the ability to help create it, and did not. That almost works as a threat.

If the probability of the basilisk being created in your lifetime is 0 (or sufficiently near 0), don't help create it. If it's sufficiently probable, do help create it.
As the probability of its create is necessarily 0 or non-0 at some point, assuming rational actors, nobody will help bring about the basilisk, keeping the probability of its creation at 0 or near-0, and thus ensuring that it never becomes likely enough to warrant helping create it.
