Who knows, mb bacteria can feel misery, they just dont have the ways to convey how they feel. Even rocks might be able to feel miserable.

I am ashamed to say this, but emotions are a social construct. If you want an object you can interpret as miserable, there is no minimal solution to prove it is, without granting it social instincts (so that it can relate to your definition of misery) and the ability to converse (so that it can confirm it is miserable).

Then again, it is still shaky, since a script that prints 'I am miserable' even if it is happy can pass as miserable.
