The trick is to err strongly against the possibility of wrongful conviction, since that is far worse, since it's men who have historically shaped the concept of justice itself, since it's men who do in fact have a real sense of justice (as opposed to an often counter-productive feminine ethic of care).
Why does it devolve upon the state apparatus to try to rehabilitate the worthless, except as the simplest palliative at the service of the life worthy of life? Why should anyone care? Do not say: because of previous injustices. Each individual is atomically responsible for himself.
