There may be multiple reasons as to why a Penal Code prevents someone to have jurisfiction on a relative in a case and it depends on the country. For the most part, why it is important to be set on whether the defendant is a relative is to prevent bias.
But again that's just an assumption, it mostly depends on the country that has jurisdiction why they have such a provision
