It is in fact a social construct. First as the above anon mentionned, as a bogeyman. Second as a social fact appearing in a certain environment.
Rapists who do kill their victims do it for specific reasons. Some do it because she resists, a reaction that depends on the society she's raised in. Some do it to hide their crime, motivated by the efficiency of law enforcement. Some do it out of spite against women, which mostly happens where they are not subjected to men.
Crime is always a social construct, obviously, but the murderous rape is because of these reasons more likely to be constructed in modern societies.
