All actual orbits are (at least slightly) elliptical: The (fixed) energy oscillates between higher speed when the orbit is close, to higher altitude when farther away. But photons can't change speed like this. Approaching the event horizon they would either pass inside and be consumed, or not pass inside, and escape.
