I was on the y!gal site for a while, I saw quite a few works not tagged well. I never saw any of them removed for that. If they were improperly tagged or if they didnt get a major tag (such as golden showers or such), then the image could get flagged by a viewer and get reviewed. While I was there the site always gave the artist a chance to reupload the image with the proper tags. Continuing to post that image without tagging for those I agree on getting penalty for. But I Never, NEVER heard of anyone banned for not tagging "his work down to the program and hours wasted on his work".
In addition, the whole "Do not post pictures of yourself or other RL people" was clearly in the rules. That was part of their ToS in order to protect the site from different legal actions and governments. They DID have legal issues, not regarding RL pics, but over issues of advertisers and some govts trying to take the site down for multiple different reasons over multiple different times. They made the rule for a reason, people deliberately trying to break a rule get their punishments deserved.
"One strike you are out" management is also news to me. If I recall the ToS from... 2 years ago now? I think, the penalty was based on the action done. Clear illegal content was met with a ban, but why would that be wrong? Simple things, like tagging improperly, resulted in the image being taken down and a message explaining why, along with a basic warning. Reuploads permitted. Rarely would a person get banned unless they broke several rules and already received suspensions 2 or more times prior.
To finish this long rant up, even though I know you are not going to read it cause you disagree with what I am saying, I was there for not one or two, but FOUR different amnesty events. Very unlike "One strike you are out".
