Contesting a Grade

Hey /sci/, just wanted your input on how far I should be willing to go in contesting my grade.
The syllabus for my class is explicit;
>25% for labs
>25% for HW
>25% for midterm
>25% for final
However, the professor has set up the grading using the grading software in such a way that it doesn't function like this, so all assignments are simply "points" irrespective of what kind of assignment they are. The tests are 30 points, and the labs are 100 each, meaning one single lab is worth more than the midterm. I missed a few labs due to illness and familial health problems, and currently have a D in the class, despite the fact that I have a near 100% on both the midterms and homeworks. I did the math, if the points were calculated properly, I'd have an 88%, but instead I have a grade in the low 60s.
I've spoken to the professor regarding this, and refuses to change the grading system citing "too many other students will fail if I were to change it" despite the fact that the grading system is totally incongruent with the syllabus. What do?
