in the case of war this very likely to occur
however if a nuclear attack is planned it will be executed in a way where there is little chance of payback
given the arsenals of leading nuclear powers they will just launch a massive amount of warheads to completely planarize the other nation
EMP makes sense when a nuclear power is fighting a non nuclear power and wants to ensure quick victory
EMP also have the problem that they have a massive area of effect, so not exactly a precisions tool, which could discourage their use
