Marvel doesn't need any permissions from Universal to do anything they want with the Hulk. They own all the rights to the character and licenses and such and can do whatever they want without ever calling Universal up. It's a completely different deal than the Spiderman or the X-Men situation.
Say that Marvel wanted to make The Super-Incredible Hulk. The only involvement Universal would possibly have is that they would have the right of first refusal to distribute the film. They can't veto it, and they can't influence its production in any way; all they can decide is whether or not they want to distribute it. If they say yes, then they distribute the movie. If they pass, then Disney does. Movie's the exact same either way.
Sony, on the other hand, was all up in the Spiderman business and that deal had to be conked out. And since one of the stipulations of that deal was that Sony distributes Homecoming, Marvel is clearly willing to let other studios distribute if they have to. The only thing keeping them from making a stand-alone Hulk movie is that they don't really want to, and personally, I think Hulk works a lot better as a supporting character anyway.
