They may call it a war, but it wasn't; Tony was a representative of the duly appointed/elected authorities, and Cap was a fugitive from the law. That makes this an arrest, and Cap wasn't using lethal force, or guilty of anything carrying the death penalty.
In any case, Tony and Cap were good friends, something modern writers seem to have difficulty getting their head wrapped around, so neither would have killed the other.
Not that 'Civil War' wasn't utter madness in that regard anyway. In his own series, Tony as much as stated that his mind was messed up because of Extremis, and it took the war (read: Cap dying) to shake him back to normal. Still doesn't explain why Cap was behaving like that. He 'lost' a few hours early in the series, but nothing was ever made of that.
