It's not really 'enough' of a difference. If they had made a character spider-woman but had her living with an aunt and uncle, and she had certain powers and/or a red and blue uniform, etc. etc.
There's a reason McDonald's sends cease and desists letters to people who open fast food or small restaurants and try to call them McCurry or McMex or similar. They tried to stop Quality Inn, the small hotel chains, from starting a new set of hotels called McSleepy Inns (or something like that) but that cased had to be settled. One of the reasons McDonald's can succeed, of course, is their resources, which quite possibly Marvel didn't have in those days.
