The irony here is that Marvel and DC have done this with living actors repeatedly, but the most high profile cases involved actors who took it as a compliment and indicated publicly that they wanted to play those roles should the properties become live action films (Sam "Nick Fury" Jackson and Simon "Wee Hughie" Pegg). In Jackson's case he gave permission contingent on getting the role.
This dude IS an actor (possibly even SAG) but neither DC's nor Marvel's film productions have shown any interest in physical resemblance to drawings as a make-or-break when casting a production.
Worst case scenario for him is a nonspeaking cameo in Joker drag essentially playing himself.
