It's like an even worse of that hospital scene in The Dark Knight. It's Harvey being reduced to an impotent schmuck to paint The Joker as le master of manipulation. Only this time it's even worse because in the movie, it made some sense since that Harvey was hospitalized, traumatized and genuinely helpless. Here, he is perfectly fine, has been a criminal for years, and has a fucking gun pointed to Joker's head. And, even though he is a lawyer, even though Harvey takes little bullshit from anyone, and even though he has a gun, all he says is a "S-shut up!" while The Joker monologues as usual.
But the worst part is that Joker cripples him with the line

And he just gives up, without even flipping his coin. Harvey chose, of his own free will, to relent and be defeated by the Joker's points, without even a retort. Because Scott Snyder's Joker is an all-knowing, all-powerful master villain who can crush everyone with just a few words, regardless of whether or not it makes sense for the other characters
I mean, imagine if Two-Face was a reckless and mentally ill man compelled to flip his coin whether to perform or not perform an action no matter what anyone else says ? Then this scene would simply not work, right ?
Thank god Snyder's Harvey is just an evil chump, no different than the other evil chumps of Gotham, ready to be knocked around by the allmighty "greatest villain of all time" Joker.
