Within their world the concept of the law keeping someone like Joker alive HAS to be overlooked as a non-existent entity while at the same time acknowledging that Joker only stayed around for the same reason in truth he does now....he makes money so you can't kill him....at least it would be the argument if he decades of history instead of being a random world created recently. So you're back to Batman.

We can mark off the writers since they are untouchable Gods we're meant to ignore. The law??? They are just doing what the untouchable Gods tell them to by somehow allowing someone that's surely killed thousands of people before the nuke incident already simply because he's the Joker to live and has escaped probably...what..200 times? That sounds possible.
We're left with the one thing we're supposed to be presented with and take as fact as it's the character we're SUPPOSED to pay attention to and think of as being a person and not just puppet from the writers.
