Yes, you can move past the silly origins, but you don't get a superhero film then. You get an action film about people with powers. The silliness is part of the charm, and ignoring that charm is like making Generic Action Movie 4235: The Reckoning.
The reason why X-Men is tonally different from the other comic book movies is that they utilize-hell, they thrive off of the messages of discrimination that have been part of the X-Men franchise since its advent. Every single movie of the main X-men line have that connection in their theme, either in finding their place in a world that hates their kind or trying to stop others who are against their kind in some sort of way. The theme is the defining factor.
Winter Soldier stands out because they have a good theme too. Steve is dealing with the fact that he's a man out of time. He's constantly being fed the differences between where he was then and where he is now. He has to deal with figuring out where his place is in this new world where things seem like they're getting better, but there are still people out there who want to ruin it. This is coupled with tension, buildup, and dramatic pulls.
The biggest problem I see in all of this is that people are immediately assuming Civil War is going to be worse because of the ability to joke. Fury's robot car told him his air conditioning is working properly while being shot at, and Winter Soldier came out fine.
