Even during investigation, the group can (an indeed is expected to) continue operating as if it had tax exempt status. The group would only be hindered if the investigation resulted in tax exempt status being denied, and it was not. Conservative groups were not "suppressed by the IRS."

3.) Under a plain meaning reading of the law, NONE of the groups should have been given tax exempt status. In order to qualify for tax exempt status, a 501(c)(4) group must "operated exclusively for the promotion of social welfare." Regulatory agencies have reinterpreted that to mean "mostly" for social welfare, so that a group can spend 49% on political campaigning as long as it spends a majority on social welfare. The problem with this interpretation is that giving to another 501(c)(4) counts as social welfare, so groups can (and do) simply spend 49% on political campaigning and then give the rest to another 501(c)(4) group that does the exact same thing.
4.) When political groups founded with the stated goal of paying less in taxes apply for tax exempt status, why shouldn't that raise eyebrows at the IRS?
