Duke, and We Are Robin as a whole, was about a ground-level, grassroots response to crime and supervillainy by normal people inspired by superheroes. They might have worn the colors and had masks, but they fundamentally weren't superheroes; they were essentially a militia. Duke shouldn't be a part of the Batfam at all. He should be an associated figure but as an ally that, while useful, is ultimately not under Batman's control. To paraphrase a Hypercrisis thread, crime is an idea; Batman is a better one. However, you can't really control an idea once it spreads and you can't really control how people interpret it either. Duke should represent the normal citizenry of Gotham fed up and lashing out at crime and villainy, a double-edged sword that can either make things worse or help bring them to heel. Clownhunter is centered around a similar concept, but he's much more Foolkiller by way of Punisher than what I'm talking about.
