Batman WANTS to kill Joker but he is determined to be an example of the law. Sure he breaks it by being a vigilante but he fully acknowledges and embraces and does everything in his power not to disrupt actual police work that will lead to proper convictions. He just wants to drop the perp and the evidence at the door.

He wants the law to work correctly. When the law can control the criminals, then Batman isn't needed in Gotham anymore. But the comics story machine requires a constantly broken Gotham, and bad writers and honestly bad fans like to out that in Bruce's shoulders when it's not really a fair view.
