Oswald stays almost entirely in Gotham though. There's been occasions he ventured elsewhere but his empire basically stays in Gotham (he has this whole thing about thinking Gotham belongs to him alone and seeing Batman as little more than a bully who's spoiling his playground)
And while Fisk rules all of NYC and then some, Oswald has to share with the likes of Black Mask, Two-Face, Scarface, and the other super criminals who aren't aligned with him, plus other rogues like The Joker who can't be controlled.
Oswald as a crimelord just isn't on Fisk's level.
He shouldn't be made to be more like Kingpin anyway. I'd say Penguin is a better supervillain, better at pulling his weight against people above his weight class than Fisk and at evading trouble, but as a crimelord, Fisk is just vastly superior.
