How do you even think physics research works, exactly? Just because a set of rules is incomplete or inadequate doesn't mean it's wrong. I mean, they still teach Newtonian physics in every highschool, even though those are demonstrably wrong or at least grossly inadequate in many cases. Why? Because they're still functional in pretty much any situation that is relevant to a high-schooler, because they make a foundation for further study down the line, and because most of the complex stuff about how physics actually work are both too complex for a kid and still in active research so they don't make for good teaching material.
Just as it would be pure idiocy to teach quantum mechanics and shit like that in high school, you're a complete retard to assume the court is ignoring the ether and its implications just because a bunch of fucking 14 year olds aren't being instructed about every detail of it in school.
