What mattered was the non-powered population. If people had obeyed the law, none of this would have happened - but they didn't trust their own government or Tony Stark enough, as if Tony was going to turn them into the President's private pretorian guard or something.

Mentallo had created a network of telepaths controlled by him to rule the world, but Tony has a system to protect himself from mental take-over. (He's actually had defenses against telepathy since about 1982, when he developed them to defend himself from Moondragon, undoubtedly refining them since).
When Mentallo drew him in, Tony managed to defeat him by surprise - and found himself in the position Mentallo had occupied, with the ability to control everyone on Earth. He could have done anything at all - create global peace, or make himself king of the world, or make every woman on the planet subconsciously attracted to him. Instead, with seconds to decide, he opted to erase the knowledge of his secret identity from anyone who knew. And that was all.
He lost no time in explaining it to his friends... and everyone was pretty upset that he had done it. That was the whole point of the annual this happened in: should he have done that? He wasn't even sure himself. He had done it to save lives, including his own.
Captain America was seriously pissed off and chided Tony for it, and then he ended up in a very similar situation, and ended up choosing the same way.
