And if Action Comics #1 became public domain, that means 1938 stuff is also PD too, so that would cover Action Comics #1 to at least #7, maybe #8 or 9. Action Comics #1 says June 1938 on the cover, but it was actually published in April. If the cover month is two months ahead of when it was on the stands, that means it'd go up to Action Comics #9 (which was coverdated February 1939, meaning it would've been published December 1938).
You might get an early version of Jimmy Olsen, because Action Comics #6 would be PD in that scenario, but he's not called Jimmy Olsen yet and is blond.
You'd only get George Taylor and the Daily Star, because the Daily Planet and Perry White doesn't appear until 1940.
For Ma and Pa Kent, you'd have to wait until the year after Action Comics #1 became PD, because they don't appear in comic until Superman #1 which was published in 1939. And I don't think they're called Jonathan and Martha yet.
But everyone else definitely came much later so even if 1938 to 1940 stuff went PD, DC doesn't have much to worry about. Legion of Superheroes, Bizarro didn't get introduced until 1958, Lori Lemaris didn't get introduced until 1959, etc.
