even if Bendis wanted to do a legion story im not sure why jon would have to be older. He already was going on galaxy spanning adventures with robin.
or if he was "too young" just have him in Legion Academy (which would be fine for bendis to make a bunch of shitty OCs)
geoff johns had a perfectly good set up for LoSh not sure how Bendis got to override his work.
